Sample VOLUNTARY SURRENDER

KNOW ALL MEN BY THESE PRESENTS:
I/WE, the undersigned, being the mortgagor under the Deed of Chattel Mortgage referred to in the schedule below, in view of my failure to comply with the terms and conditions of the said deed/s, hereby voluntarily return/surrender, transfer and convey to you the unit/s and all my rights, title or interest therein.
I/WE, acknowledge and agrees that on your taking possession of the units I will be regarded as having forfeited any right of interest in the said unit/s and that all payments for monthly installments or rentals so far made thereon are forfeited and and considered as payments for the use and depreciation of the said unit/s.
I/WE, further acknowledge and agree that, after accepting the surrender/return of the said unit/s you are allowed to sell, dispose of or deal with the said unit/s in any matter, at any time in absolute discretion.
This voluntary surrender is also subject to the following special conditions:
THAT NO FURTHER LIABILITIES AND OBLIGATIONS AGAINTS MARLENE CASTRO AND/OR BEN CASTRO; UPON THIS VOLUNTARY SURRENDER WAS MADE AND THAT ALL PAYMENTS FOR MONTHLY INSTALLMENTS WILL ALL BE CONSIDERED PAID. AFTER ACCEPTING THE SURRENDER/RETURN OF THE SAID ONE(1) UNIT (DACION ENPAGO)
